• Count One: False Statements (18 U.S.C. § 1001(a)(2)): Alleging Comey "willfully and knowingly" made a materially false statement to a U.S. Senator by denying that he had authorized someone at the FBI to be an anonymous source in news reports regarding an investigation.
• This statute broadly prohibits making materially false or fraudulent statements in any matter within the jurisdiction of the executive, legislative, or judicial branch of the government.
• Count Two: Obstruction of a Congressional Proceeding (18 U.S.C. § 1505): Alleging Comey "did corruptly endeavor to influence, obstruct and impede" the Senate Judiciary Committee's inquiry by making false and misleading statements.
• If convicted, Comey faces a maximum of five years in prison on each count.

Erosion of DOJ Independence

The procedural circumstances surrounding the charges suggest a profound institutional breakdown:

• Targeting and Retribution: The indictment came after President Trump publicly urged action against Comey, his longtime political foe, calling him a "dirty cop" and demanding he pay a "very big price". Trump suggested Comey’s prosecution might be the first of multiple prosecutions against his enemies, signaling a strategy of "retribution".
• Political Appointments: The indictment was signed solely by Lindsey Halligan, the U.S. Attorney who replaced the ousted former prosecutor, Erik Siebert. Halligan has no prosecutorial experience and previously served on the president's personal legal team, a circumstance legal experts say could bolster a defense claim of selective or vindictive prosecution.
• Internal Disagreement: Career federal prosecutors reportedly circulated a "declination" memo, arguing that criminal charges should not be filed, underscoring concerns that the indictment may violate Justice Department policy.

U.S. Attorney Halligan acknowledged that the charges test whether the Justice Department can enforce the obligation of truthful testimony "free from political pressure".
