U.S. District Judge April Perry delivered a significant judicial setback to the Trump administration by issuing a temporary restraining order (TRO) that blocked the federalization and deployment of the National Guard in Illinois. The ruling, delivered from the bench, came in response to a lawsuit filed by the state of Illinois and the city of Chicago opposing the deployment of both federalized Illinois National Guard troops and troops from the Texas National Guard.

Judge Perry's decision temporarily halted the administration's plan to use National Guard forces to protect federal agents and facilities, including an Immigration and Customs Enforcement (ICE) detention center in Broadview. Her ruling focused critically on the administration's justification for the deployment, which relied on claims of an ongoing rebellion.

The court's central finding was a sharp rejection of the administration's assessment of civil unrest. Judge Perry stated she had seen "no credible evidence there is a danger of rebellion in the state of Illinois" or that the president was unable to execute federal laws with existing forces. She found the Department of Homeland Security's (DHS) account of recent events to be "simply unreliable."

Furthermore, Judge Perry highlighted that the conduct of federal agents themselves was responsible for escalating civil unrest. She noted evidence that the presence and actions of federal agents, including the use of chemical weapons against peaceful crowds, were actively contributing to the violence. She concluded that introducing the National Guard, who are not trained in law enforcement or de-escalation tactics, would "only add fuel to the fire that the defendants themselves have started."

The Trump administration immediately appealed the decision to the 7th U.S. Circuit Court of Appeals. While the 7th Circuit upheld Judge Perry's order blocking the physical deployment of National Guard troops, it granted the administration's request to temporarily keep the federalized troops under federal control pending a further ruling on the matter.
