The Constitutional Crisis and the Threat to American Democracy

Our democracy is imperiled by unauthorized executive military action, the shattering of congressional checks and balances, and the dismantling of government accountability. The core principle that war powers are shared, and that due process protects citizens from summary judgment, is being openly violated.

THE UNILATERAL ASSUMPTION OF WAR POWERS

The Executive Branch has asserted a dramatic and unprecedented authority to wage war against civilian criminal suspects, equating drug trafficking with armed conflict against the United States.

• Summary Execution and Lawless Force: U.S. military forces have conducted lethal strikes against at least three vessels in the Caribbean, resulting in at least 17 deaths. Critics denounce these actions as a "lawless abuse of lethal force" and the "summary execution of people who are not at war with the United States".
• Warping the Law: The administration claims the use of military force is justified as "self-defense" against "narcoterrorists". Legal experts argue that the assertion that drug smuggling is the same as "hurling a bomb against the United States" is a "very, very bold claim" lacking legal precedent.
• Forfeiting Justice: Senators argue that destroying a drug boat is counterproductive because it forfeits evidence and access to individuals that could lead to "kingpins". Standard practice involves interdiction (boarding, seizure, and arrest) by the Coast Guard, not military attack.

THE COLLAPSE OF CHECKS AND BALANCES

The Executive Branch has actively "stiff arm[ed] the article one branch" by refusing to provide Congress the legal rationale for initiating hostilities, fundamentally undermining oversight.

• Ignoring Congress: 25 senators sent a letter demanding urgent answers regarding the legal authority for the military strike and the intelligence used to identify targets. The administration failed to respond by the seven-day deadline.
• The War Powers Challenge: Due to the failure to respond and the continued flouting of the law, Senators Kaine and Schiff introduced a War Powers Act resolution to force a debate and vote in Congress to block the unauthorized strikes. The resolution seeks to reaffirm that drug trafficking alone is not an armed attack justifying military action.
• A Shattered Balance: This lack of transparency means "life and death decisions can be made in the shadows without explanation". When the President conducts military operations without informing Congress, the balance of power "doesn't just wobble, it shatters".

THE EROSION OF ACCOUNTABILITY

The mechanisms designed to ensure accountability within the government are under attack, making oversight optional.

• Violation of IG Independence: A federal district court found that the President "violated the IGA" (Inspector General Act) by removing eight Inspectors General, including the DoD IG, without notifying Congress or providing a rationale.
• Flouting Statutory Limits: The court agreed it is "decidedly wrong and decidedly contrary to the public interest" for the President, who is constitutionally charged with executing laws, to flout statutory limits designed to protect oversight.
• A Survival Issue: If IGs cannot operate freely or are dismissed when the truth becomes inconvenient, the integrity of the government is compromised, which is a "survival issue for democracy".
